{"id":639,"date":"2022-11-21T11:04:06","date_gmt":"2022-11-21T10:04:06","guid":{"rendered":"https:\/\/demo10.positive.it\/?post_type=publications&#038;p=639"},"modified":"2024-03-28T16:13:55","modified_gmt":"2024-03-28T15:13:55","slug":"sblocca-trivelle-the-council-of-ministers-approves-the-aiuti-quater-law-decree-and-gives-the-green-light-to-gas-production-concessions-with-high-mining-potential-within-12-nautical-miles-of-the","status":"publish","type":"publications","link":"https:\/\/www.unlaw.it\/en\/publications\/sblocca-trivelle-the-council-of-ministers-approves-the-aiuti-quater-law-decree-and-gives-the-green-light-to-gas-production-concessions-with-high-mining-potential-within-12-nautical-miles-of-the\/","title":{"rendered":"Sblocca trivelle: the Council of Ministers approves the &#8220;Aiuti Quater&#8221; law decree and gives the green light to gas production concessions (with high mining potential) within 12 nautical miles of the coastline"},"content":{"rendered":"<p>To tackle the energy crisis, the \u201c<em>Aiuti quarter<\/em>\u201d law decree (no. 176\/2022), published in the Official Gazette (<em>Gazzetta Ufficiale<\/em>) last Friday and came into force Saturday, November 19, introduced a provision (the so-called \u201c<em>Sblocca-Trivelle<\/em>\u201d), which limits the current ban on the exploration of gas fields at sea, already subjected to several regulatory interventions over the last years.<\/p>\n<p>The new provision contained in Article 4 (\u201cMeasures to increase natural gas production\u201d), establishes that:<\/p>\n<ul>\n<li>granting\u00a0<strong>new concessions<\/strong>\u00a0for the production of (liquid and gaseous) hydrocarbons between\u00a0<strong>9 and 12 miles<\/strong>\u00a0from the coastlines and the outer perimeter of protected marine and coastal areas is allowed, limited to sites with a gas\u00a0<strong>mining potential\u00a0<\/strong>for a\u00a0<strong>certain reserve quantity<\/strong>\u00a0<strong>exceeding 500 million cubic metres<\/strong>;<\/li>\n<li>operators who acquire ownership of these concessions are required to comply with the\u00a0<strong>GSE tender procedures<\/strong>\u00a0for the\u00a0<strong>long-term<\/strong>\u00a0supply of natural gas;<\/li>\n<li>the same procedures apply to production concessions located in the stretch of sea\u00a0<strong>between the 45<sup>th<\/sup>\u00a0parallel and the parallel passing through the mouth of the Goro branch of the river Po<\/strong>, at a distance of more than\u00a0<strong>9 miles<\/strong>\u00a0from the coastline and with a gas mining potential for a certain reserve quantity above a threshold of\u00a0<strong>500 million cubic metres<\/strong>;<\/li>\n<li>the abovementioned production is allowed for the duration of the useful life of the deposit on condition that the holders of the concessions comply with the\u00a0<strong>procedures of the GSE<\/strong>\u00a0and by submitting technical-scientific analyses and detailed monitoring and verification programmes of the\u00a0<strong>absence of significant effects of subsidence<\/strong>\u00a0on the coast lines assigned to the Ministry of the Environment and Energy Security.<\/li>\n<\/ul>\n<p>Therefore, the exemptions are valid only for gas production concessions (not for liquid hydrocarbon permits) and, in particular, for sites characterised by a\u00a0<strong>high mining potential<\/strong>\u00a0(the deposit with a capacity of more than 500 million cubic metres).<\/p>\n<p>According to the Government\u2019s estimates, an additional\u00a0<strong>15 billion cubic metres of<\/strong>\u00a0<strong>gas in ten years<\/strong>\u00a0will be available, to be allocated to Italy\u2019s energy-intensive companies.
